A woman has been fined £2,000 for failing to comply with requirements of an enforcement notice issued by the Northern Planning Service.
The notice arose out of an unauthorised extension of a property on Roulston Avenue in 2006.
Gail Logue, of Millgrove Park, Eglinton had applied for the extension and was refused by the Planning Service and after appealing the matter was again refused.
She still didn’t comply with the notice by July 1 last and the Planning Service began proceedings against her.
A defence solicitor told the court the property was the defendant’s family home where she grew up.
She continued her client’s mother continues to live in the house and is an elderly lady.
With regards to the extension the solicitor stated “Her husband was a builder and they believed planning permission would be granted.”
However she added given the current economic climate they would have difficulty paying for the work to be carried out to remove it.
She said the estimated cost of the work was approximately £15,000.
District judge Barney McElholm stated: “It was extremely fool hardy and recluse to build without permission.”
